What Counts as Domestic Violence?
Most people think of domestic violence as family violence and, more specifically, as violence between a husband and wife. This is an understandable assumption given that the majority of cases are of that type. In truth, however, domestic violence is defined much more broadly by Arizona law.
First, the violence in question doesn't have to be a punch or a kick. It can be something as simple as making a call to someone who has an order of protection against you. It can be a threatening remark. It can be any type of unwanted touching or offensive contact at all. The only requirement for the charges to be classified as DV-related is that the people involved are related or have lived together at some point in their lives. This means parents, children, stepparents, relatives, boyfriends, girlfriends, domestic partners, roommates and a virtually unlimited number of other people could qualify.
Common Domestic Violence Charges and Potential Consequences
- Disorderly conduct
- Assault
- Aggravated assault
- Assault, harassment, stalking or intimidation
- Child abuse
- Sexual abuse
- Violation of a restraining order
In addition to jail, court costs, fines and other criminal penalties. DV offenders are often ordered to complete a domestic violence treatment program, attend anger management classes and do community service as well. That said — the severity of the punishment for any given crime depends largely on the facts and circumstances unique to that case.
